GENERAL AND SPECIFIC TERMS OF SALE
These General Terms of Sale (hereinafter "GTS") govern the contractual relationship between Toutankhaone, a travel agency registered in Egypt, and any individual or legal entity wishing to benefit from the services offered by the agency.
Any booking or order implies unconditional acceptance of these GTS.
Article 1: Purpose
These GTS define the rights and obligations of the parties in the context of the sale of tourism-related services offered by Toutankhaone, including tours, excursions, accommodation, transportation, and other travel-related services.
Article 2: Legal Capacity
The client declares having the legal capacity to enter into a contract, meaning they are of legal age and not under guardianship or curatorship. In the case of a reservation made on behalf of third parties, the client confirms they have been duly authorized to act on their behalf.
Article 3: Formation of the Contract
The contract is considered concluded upon the signing of the quote containing the mention "Approved" ("Bon pour accord") or upon acceptance of the proposed services.
This acceptance may be provided in writing, including electronically (email, instant messaging, etc.).
Article 4: Pre-contractual Information
In accordance with the provisions of the Tourism Code, Toutankhaone provides the client, prior to contract conclusion, with information relating to the main characteristics of the services, the total price, payment terms, cancellation conditions, and any insurance offered.
Article 5: Prices and Payment Terms
Prices are stated in euros, inclusive of all taxes. Additional local taxes (such as tourist tax, environmental tax, etc.) may apply and are to be paid by the client on-site.
Payment for services is to be made as follows:
* A 25% deposit of the total amount is due at the time of booking.
* A second 25% payment is due no later than the day before the services.
* The remaining balance is payable on the day of the service.
For packages including a Nile cruise, the deposit may range from 50% to 100% of the total amount, depending on the cruise provider's policies.
Payments may be made by bank transfer or in cash. Any transaction fees are the responsibility of the client.
Article 6: Price Revision
In accordance with applicable law, prices may be revised upwards or downwards to reflect significant changes in transportation costs, service-related taxes and fees, or applicable exchange rates relevant to the booked travel services.
Article 7: Service Conditions
The duration and features of each service are outlined in the booking contract and in the activity descriptions available on Toutankhaone’s website.
The client agrees to respect the scheduled times to ensure the proper delivery of services. In the event of an unreported delay, the reservation will be maintained at the provider's discretion. If an activity cannot be carried out due to the client's delay, no compensation will be given.
Certain activities may be canceled due to weather conditions, force majeure, or failure to meet the minimum required number of participants. In such cases, an alternative or rescheduled activity will be proposed. If no suitable solution is found, the client will be refunded for the canceled activity without further compensation.
Article 8: Changes and Supplements
Any changes to the initial program requested by the client may result in additional charges, which will be borne by the client. Services not included in the original package must be paid for on-site.
Article 9: Transfer of Contract
The client may transfer their contract to a third party who meets the same conditions for the trip, provided Toutankhaone is informed in writing at least 24 hours before the services begin. The original and new clients are jointly responsible for full payment and any costs incurred due to the transfer.
Article 10: Cancellation by the Client
In case of total or partial cancellation by the client, the following fees will be charged:
* From the 30th to the 21st day before departure: 25% of the total price.
* From the 20th to the 8th day: 50% of the total price.
* From the 7th to the 2nd day: 75% of the total price.
* Less than 2 days before departure or no-show: 100% of the total price.
Cancellations must be communicated in writing (email, SMS, or instant messaging).
If the client has purchased personal cancellation insurance, they should refer to the terms of their insurance contract for possible reimbursements.
Article 11: Cancellation by Toutankhaone
Toutankhaone may cancel a service at no cost to the client in the following cases:
* If the number of participants is below the required minimum, and cancellation occurs at least 20 days before departure for trips over 6 days, 7 days for trips of 2 to 6 days, or 24 hours for trips under 2 days.
* In case of exceptional and unavoidable circumstances preventing the service from being delivered.
In such events, the client will be fully refunded the amount paid, with no additional compensation.
Article 12: Liability
Toutankhaone is responsible for the proper execution of services under the contract, except in cases of force majeure, client fault, or an unforeseeable and unavoidable act by a third party.
Toutankhaone is not liable for changes or cancellations caused by local service providers or for consequences arising from external events such as strikes, adverse weather conditions, or administrative decisions.
Article 13: Force Majeure
Force majeure refers to any external, unforeseeable, and irresistible event that makes it impossible to fulfill contractual obligations. In the event of force majeure, the parties’ obligations are suspended for the duration of the event.
If the service cannot be carried out, a rescheduling or alternative solution will be proposed to the client.
Article 14: Personal Data
Toutankhaone collects and processes client data in accordance with the General Data Protection Regulation (GDPR).
Clients have the right to access, correct, delete, and oppose the processing of their personal data. These rights can be exercised by contacting Toutankhaone at the following email: **[toutankhaone@gmail.com](mailto:toutankhaone@gmail.com)**.

Article 15: Insurance
Toutankhaone strongly recommends that clients purchase insurance covering trip cancellation, medical repatriation, and civil liability. Clients are responsible for any damages caused by them and must have suitable insurance coverage.
Article 16: Complaints and Disputes
Any complaint related to a service must be addressed to Toutankhaone during the trip via email, SMS, or instant messaging.
Otherwise, the complaint will not be considered.
In the event of a dispute, both parties will attempt to reach an amicable solution.
If no agreement is reached, the client may refer the matter to the **Tourism and Travel Mediation Service (MTV)** or use the European Online Dispute Resolution platform:

These GTS are subject to Egyptian law, and any dispute relating to their interpretation or execution shall fall under the jurisdiction of Egyptian courts.
Article 17: Meals
Meals included in the services are provided at establishments selected by Toutankhaone's local partners (guides, drivers, local agency).
The agency cannot be held responsible for the quality of the meals served.
Clients must inform the agency in advance and/or on the day of the activity of any allergies or specific dietary requirements.
Article 18: Accessibility
Some services may not be accessible to persons with reduced mobility or elderly individuals.
Clients are required to inform Toutankhaone of any specific condition so that the services can be adapted accordingly.
Article 19: Final Provisions
If any clause of these GTS is deemed null or unenforceable, the remaining provisions shall remain valid.
Failure by Toutankhaone to enforce a clause at a given time shall not be construed as a waiver of its right to enforce it later.
